Hotel and private lodging support services

​当事務所では旅館業・民泊支援の申請代理や事前調査等を支援をさせていただきます。このページでは民泊新法(住宅宿泊事業法)について簡単に記載しておりますが、旅館業許可申請についてもご相談承ります。旅館関係は用途地域や立地に関して考慮することや消防法や都道府県条例とも関係しますので事前の検討が重要になります。また、飲食店営業許可も必要になる場合もありますので「何をしたらいいのか」、「どこから手を付ければいいのか」迷っている方は是非協力させていただきます。

Hotel type

The types of hotels and inns are classified as follows. If you wish to operate for more than 180 days, your private lodging will be considered a "simple lodging business."

​旅館・ホテル営業

General inns and hotels. Other than simple lodgings and boarding houses.

Simple lodging business

When operating an accommodation facility that is shared by multiple people and has structures and facilities

This applies to mountain huts, bed houses, youth hostels, and capsule hotels.

Boarding house business

Business that provides lodging for a period of one month or more

What is the New Private Lodging Law (Home Lodging Business Law)?

To operate an accommodation business, you need a hotel business license, but if you submit a notification under Article 3, Paragraph 1 of the Private Lodging Business Act, you can operate the business so long as the number of days you host guests does not exceed 180 days in a year. If you plan to host guests for more than 180 days, you will need to apply for a license under the Hotel Business Act. Unlike the Hotel Business Act, you can also refuse to accept guests as long as it is within reasonable limits.

Accommodation businesses are divided into three categories

The Private Lodging Business Act separates private lodging businesses into three groups: private lodging operators (private lodging hosts), private lodging managers (private lodging agencies), and private lodging intermediaries (intermediaries such as Airbnb). Each group has its own rules.

Home accommodation businesses are classified into two types: "owner-occupied" and "owner-absent"

・Hygiene measures

・Explanation of noise prevention measures for guests

・Responding to complaints from neighbors

・Creating and maintaining a guest list

・Displaying signs, etc.

​標識の掲示を除く上記措置を「住宅宿泊管理事業者」に委託することを義務付け。​

​住宅宿泊管理事業者とは、国土交通大臣の登録を受けた者をいいます。住宅宿泊事業者が管理者に委託料を払うことで苦情や安全確保などを代わりに行ってくれます。

Facility requirements

- A house currently being used as the base of human life

- Houses that are looking for tenants

- A house that is used as a residence for its owner, tenant or subtenant at any time.

-Facilities include a kitchen, bathroom, washing facilities, and toilet.

・Floor space of at least 3.3㎡ must be secured per guest.

The bathroom does not have a bathtub, and it is okay to have just a shower. Unit baths are also permitted.

Need for change of use for building confirmation?

Regarding changes to the use of building confirmation (if the building confirmation is for "residential or apartment building")

If you wish to obtain a hotel business license, you will need to change the use to "hotel/inn."

A registered dwelling under the Residential Accommodation Business Act is considered a "dwelling," so there is no need to change its use.

If you plan to provide food to guests, you will also need to apply for a restaurant business license. Since it may take some time to meet the kitchen requirements, you will need to apply for both at the same time.

*Regulations have been relaxed for private lodging facilities where the owner lives in the home, and requirements for kitchens have been relaxed.
